1. Definitions

For the purposes of these Terms of Service:

• "Bot" or "Service" refers to Concord Bot, a Discord application
• "We", "Us", or "Our" refers to Concord Bot and its operators
• "You" or "User" refers to any individual or entity using the Bot
• "Server" or "Guild" refers to a Discord server where the Bot is used
• "Social Credits" refers to the virtual currency system within the Bot
• "Dashboard" refers to the web interface at concord.online

2. Acceptance of Terms

By accessing and using Concord Bot ("the Bot", "the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

3. Description of Service

Concord Bot is a Discord bot that provides moderation, verification, and social credit features for Discord servers. The Bot operates on Discord's platform and is subject to Discord's Terms of Service and Community Guidelines.

Age Restrictions: The Bot itself does not enforce age restrictions. Any age requirements are determined by the individual Discord server where the Bot is used. Discord's Terms of Service require users to be at least 13 years old.

4. User Responsibilities

You agree to:

• Use the Bot in compliance with Discord's Terms of Service and Community Guidelines
• Not use the Bot for any illegal or unauthorized purpose
• Not attempt to harm, disrupt, or interfere with the Bot's operation
• Not abuse, exploit, or manipulate the Bot's features or systems
• Respect other users and maintain appropriate conduct
• Ensure you have proper permissions to use the Bot in your Discord server

5. Prohibited Uses

You may not use the Bot to:

• Violate any applicable laws or regulations
• Harass, abuse, or harm other users
• Spam or send unsolicited messages
• Impersonate other users or entities
• Distribute malware or harmful content
• Circumvent or attempt to circumvent any security measures
• Use automated systems to interact with the Bot without authorization

6. Moderation Actions

The Bot provides moderation features that allow users to perform actions such as timeouts, mutes, and role management. These actions are performed at the user's discretion and responsibility. We are not liable for any moderation actions taken using the Bot.

Moderation Accuracy Disclaimer: The Bot may occasionally perform incorrect or unintended moderation actions. We do not guarantee the accuracy or outcome of any moderation action performed through the Bot. Users are responsible for verifying the appropriateness of moderation actions before execution.

7. Social Credits System

The Bot includes a social credits system where users can earn credits through voice channel participation. Credits are virtual currency and have no real-world value. Credits cannot be exchanged for money, goods, or services outside of the Bot's features.

Gambling and Wagering Prohibition: Credits cannot be wagered, gambled, or exchanged for anything of monetary value. The Social Credits system is designed solely for in-Bot features and has no real-world financial value.

8. Service Availability

We strive to maintain high availability of the Bot, but we do not guarantee uninterrupted access. The Bot may be temporarily unavailable due to maintenance, updates, or unforeseen circumstances. We reserve the right to modify, suspend, or discontinue the Bot at any time without notice.

Third-Party Service Disclaimer: We are not responsible for outages, data loss, or service interruptions caused by Discord, Supabase, or other third-party services upon which the Bot depends. The Bot's availability is subject to the availability and reliability of these third-party platforms.

9. Data and Privacy

Your use of the Bot is subject to our Privacy Policy. By using the Bot, you consent to the collection and use of data as described in the Privacy Policy. We collect minimal data necessary for the Bot's operation, including Discord user IDs, server IDs, and usage statistics.

Data Deletion Requests: You may request full deletion of all data associated with your server. Absent a deletion request, certain data may be retained for a reasonable period for security and legal compliance purposes. To request data deletion, contact us through the methods provided in Section 15.

10. Cookies and Web Dashboard

Our web dashboard at concord.online may use cookies and similar tracking technologies to enhance your experience. Cookies are small data files stored on your device that help us provide personalized features and analyze usage patterns. You can control cookies through your browser settings.

By using the dashboard, you consent to the use of cookies as described in our Privacy Policy. If you do not wish to accept cookies, you may disable them in your browser, though this may limit certain dashboard functionality.

11. Intellectual Property

The Bot, including its code, features, and documentation, is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Bot without explicit written permission.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE BOT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE BOT.

Third-Party Service Liability: We are not responsible for outages, data loss, or service interruptions caused by Discord, Supabase, or other third-party services. Our liability is limited to the Bot's functionality and does not extend to third-party platform issues.

13. Indemnification

You agree to indemnify and hold harmless Concord Bot and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Bot, violation of these Terms, or violation of any rights of another.

14. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes through one or more of the following methods:

• Updating the "Last Updated" date at the top of this page
• Posting an announcement in our Discord server
• Email notification (if you have provided an email address)
• Prominent notice on the dashboard website

Your continued use of the Bot after changes constitutes acceptance of the new terms. If you do not agree to the modified terms, you must stop using the Bot.

15. Termination

We reserve the right to terminate or suspend your access to the Bot at any time, with or without cause or notice, for any reason, including violation of these Terms or Discord's Terms of Service.

Data Deletion Upon Termination: You may request full deletion of all data associated with your server at any time, including upon termination of service. Absent a deletion request, certain data may be retained for a reasonable period for security and legal compliance purposes.

16. Governing Law

These Terms are governed by the laws of the United States and the laws of the State where the operator resides, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the appropriate courts of the operator's jurisdiction.
